Is the phone a work phone or personal phone. If it is a work phone then this would be the same as copying the list from any other source at the office. If it is a personal phone then I think it gets a bit ambiguous but I would think it would still be considered taking the client list from the company since it doesn't really matter when the list was created but more that it is a list of clients you are taking.
